Terms & Conditions

The following terms and conditions govern all transportation services provided by Rolls Right Industries Ltd. Please read carefully before using our services.

Payment

Collect on Delivery (COD)

CODs are accepted in the form of legal tender (cheque, cash, money order). The carrier will not be held responsible for NSF or "bounced" cheques.

The charge for COD service is $10.00 CDN per shipment.

Regulatory

Conditions of Carriage

Conditions of Carriage per the Canadian Uniform Highway Bill of Lading and Provincial regulations respecting Motor Carrier Services are hereby incorporated by reference and govern transportation services performed under this tariff, and are subject to applicable Municipal By-laws.

Safety

Dangerous Goods

All our personnel are qualified to handle Dangerous Goods shipments. Shipper must notify Rolls Right that a shipment contains dangerous goods when placing a call for pick-up.

Shipper is responsible for supplying properly completed paperwork and placards if required for dangerous goods shipments.

Additional Services

Extra Help

Deliveries requiring an extra person supplied by the carrier will be assessed an additional charge.

Minimum $50–$60 CDN or more per hour by division, with a 4-hour minimum.

Packaging

Fragile Items

No liability shall be recognized by the carrier for damage or delay due to improper packaging or improper labeling of shipments.

No claim shall be recognized for fragile commodities such as glass, ceramics, delicate instruments, and plants unless the value is declared and the item is packaged properly.

Coverage

Liability & Declared Value

If a declared value is stated on the bill of lading, the higher value must be agreed to in writing by the carrier prior to acceptance.

Declared value shipments require an additional charge of 2% of declared value for supplementary insurance
Maximum liability is $2 per lb. unless declared valuation states otherwise
Freight Rating

Light or Bulky Freight

Light or bulky commodities will be rated subject to the standard transportation of goods cube rule.

Charged at 15 pounds per cubic foot for light or bulky items.

Equipment

Power Tailgate & Pallets

Shipments requiring a power tailgate/rail gate will be assessed an additional charge
Pallets for LTL deliveries should not exceed 5½ ft (65 inches) in stacked height
Documentation

Proof of Delivery (POD)

PODs are available free of charge under 3 months
PODs older than 3 months are subject to a $10.00 CDN charge
Compliance

Fines & Non-Compliance

Rolls Right Industries will not be liable for non-compliance or late fees negotiated between the shipper and the consignee. We understand the requirements set forth and consistently uphold our standard to provide solutions and services on time.

Pricing

Rating & Charges

All charges are in Canadian Dollars. Shipments destined to towns not named on the rate-sheet will be rated to the next farthest town named on the rate-sheet.

Payment

Payment Terms

Net on receipt of invoice
2% interest will be charged on overdue accounts greater than 45 days
Any claims for billing errors must be reported within 10 days
Detention

Trailer Demurrage & Unloading Time

Trailer rental charges will be applied to all shipments where the carrier's trailer is detained beyond normal loading/unloading time.

Normal unloading time is defined as 15 minutes at each end or 1 trailer-load. Excess time is charged at $60.00 CDN per hour in 15-minute increments.

Insurance

Valuation Charges

Valuation charges of $0.50 CDN per $100.00 CDN will be assessed when the shipper declares a shipment value in excess of $2.00 CDN per pound.

Key Points Regarding Freight Claims

Important rules that apply to all freight claims submitted to Rolls Right Industries Ltd.

Freight Charges Must Be Paid First

All freight charges on the shipment must be paid before a claim can be processed.

No Tax on Claims

GST, PST, and HST are not applicable on freight claims settlements.

Carrier Takes Possession

Upon approval of the claim, the carrier is entitled to take possession of the claimed goods.

Visible Damage Must Be Noted

"Subject to Inspection" is not verification of damage. Visible damage must be explicitly noted at time of delivery.

Default Release Value

Unless value is stated on the Bill of Lading, goods are released at a value not exceeding $2.00 per pound.

Standard Bill of Lading Terms Apply

All claim settlements, even where value is declared, are subject to standard Bill of Lading terms and conditions.

Specified Conditions of Carriage

The following articles govern the liability, responsibilities, and rights of all parties involved in shipments handled by Rolls Right Industries Ltd., per the Canadian Uniform Highway Bill of Lading.

Article 1

Carrier Liability

The carrier is liable for any loss or damage to goods accepted, except as provided in these Articles.

Article 2

Multiple Carriers

Where 2 or more carriers are involved, the originating and delivering carrier are jointly and severally liable for loss or damage occurring in any carrier's custody.

Article 3

Recovery Between Carriers

The originating or delivering carrier is entitled to recover from any other carrier responsible for loss or damage while goods were in that carrier's custody.

Article 4

Consignor/Consignee Rights

Nothing in Articles 2 or 3 deprives a consignor or consignee of any remedy or right of action against any carrier.

Article 5

Carrier Exemptions

The carrier is not liable for loss due to Acts of God, public enemies, riots, strikes, defect or inherent vice in goods, or acts of the consignor, owner, or consignee.

Article 6

Transport Timeline

The carrier is not bound to transport goods by any particular vehicle or in time for any particular market unless specifically agreed upon in writing on the bill of lading.

Article 7

Physical Necessity

In case of physical necessity, the carrier may forward goods by any conveyance or route, but liability remains the same as though carriage were entirely by highway.

Article 8

Goods Held in Transit

If goods are stopped and held in transit at the request of a party entitled to make such request, the goods are held at the risk of that party.

Article 9

Loss Computation

The amount of any loss or damage is computed on the basis of value at the place and time of shipment, including freight charges and duties paid, unless a lower value has been agreed upon.

Article 10

Maximum Liability

Loss or damage must not exceed $2 per pound ($4.41 per kilogram), up to a maximum of $100,000.00. A declared value greater than $100,000 requires written approval from Rolls Right Industries Ltd.

Article 11

Consignor's Risk

If goods are carried at the consignor's risk, this covers only risks incidental to transportation and does not relieve the carrier from liability for negligent acts or omissions.

Article 12a

Notice of Claim

Notice of loss, damage, or delay must be given in writing within 60 days after delivery, or within 9 months of the shipment date in cases of failure to deliver.

Article 12b

Final Claim Statement

The final statement of claim must be filed within 9 months of the shipment date, together with a copy of the paid freight bill.

Article 13

Extraordinary Value Items

The carrier is not bound to carry documents, specie, or articles of extraordinary value without special agreement. Without disclosure, liability is limited to the maximum in Article 10.

Article 14

Freight Payment

If the consignor fails to indicate prepaid status on the bill of lading, the carrier is entitled to transport the shipment on a freight collect basis.

Article 15

Dangerous Goods Disclosure

Any person shipping explosives or dangerous goods without full prior disclosure to the carrier is liable for all resulting loss or damage. Such goods may be warehoused at the consignor's risk.

Article 16

Undeliverable Goods

If goods cannot be delivered through no fault of the carrier, after giving notice and requesting disposal instructions, the carrier may store the goods at the consignor's expense.

Article 17

Return of Goods

If no disposal instructions are received within 10 days of notice under Article 16, the carrier may return all undelivered shipments to the consignor at the consignor's expense.

Article 18

Bill of Lading Alterations

Any alteration, addition, or erasure in the bill of lading must be signed or initialed by both the consignor and the originating carrier, otherwise it is without effect.

Article 19

Correct Shipping Weights

It is the consignor's responsibility to show correct shipping weights on the bill of lading. Failure to do so makes the bill of lading subject to correction by the carrier.
